2G licences: Why Bharti Airtel is the biggest gainer

Bharti Airtel seems to have come out clean and is likely to be the biggest beneficiary from the judgement announced by the Supreme Court.As a result of the judgement, 4.4 Mhz of 2G spectrum per circle has been freed which results in freeing up of almost 55 Mhz of spectrum. One has to wait and see how these licences are auctioned and at what price.Smaller telecom companies were making inroads in the market share of bigger companies by aggressively pricing their services. Most of the smaller companies are making operating losses as a result of this pricing strategy. This has resulted in a reduction in margin and lower client addition for most of the players in the sector.Though the smaller companies can operate for another four months, it is likely that Bharti and Idea might opt for raising tariffs for its services as the threat of competition would nBharti already has the highest number of subscribers in the country. The company as on December 2011 had 175.65 million subscribers in its fold, however, its monthly addition was slowing down. Take the case in December, while Bharti Airtel added 0.96 million subscribers, Uninor added 2.12 million. With licences of Uninor being cancelled, both Idea and Bharti are expected to benefit from the judgement as number portability can help clients to switch easily.Citigroup in a report has said that the biggest losers will be new entrants like Swan, Uninor, Sistema. They added that BhartiAirtel will be the biggest gainer as there has been no cancellation of licences for them. Moreover, with the cancellation of licences a fresh auction will take place and those prices for spectrum will be taken as base for the excess spectrum.Jagannadhan Thunuguntla, head of research, SMC Investment and Advisors, Mumbai feels Bharti Airtel and Idea Cellular will emerge as popular brands and their strong balance sheets will be clear beneficiaries because they can take advantage of this situation and increase market share.The stock gained around 7 percent at Rs 386 on likely allocation of spectrum. The shares touched an intraday high of Rs 392.95 and an intraday low of Rs 358.30. It was trading with volumes of 959,155 shares.o longer exist.

ICICI Bank has surprised the Street positively with its third-quarter results. Not only is net profit up a healthy 20 percent, its deposit and credit growth has also been quite good.Credit grew by a handsome 19 percent and Chanda Kochhar, CEO and managing director of the bank, assured that loan growth would be maintained at 18 percent for the financial year ending March 2012. She also predicted domestic credit growth for the next year at 18 to 20 percent. She said it was too early to talk about how the bank’s international portfolio of loans would perform next year.The bank’s total loan book currently stands at Rs 2,46,200 crore.Total deposits were up 19.67 percent, driven by additions in current and savings account (Casa) deposits. Casa ratio — the proportion of Casa deposits to total deposits — climbed to 43.6 percent from 42.1 percent last quarter. The bank also reported a slight improvement in net interest margin — the difference between interest received and interest paid — to 2.7 percent from 2.64 percent a year ago.Asset quality also improved significantly, with net non-performing assets coming down from 1.1 percent to 0.7 percent over the same period. Even more reassuring, provisions for possible slippages (part of loanbook that has potential to turn into bad loan) are also down.It seems the only worry for the bank lies with its restructured assets. Net restructured loans at the end of the quarter totalled Rs 3,070 crore, an increase of Rs 800 crore over the previous quarter. Kochhar said there would be more restructuring of corporate debt in coming quarters. Nevertheless, the bank’s asset quality is expected to remain under control.Quelling concerns about where credit growth had come from, Kochhar explained the growth main came from working capital requirements for companies and loans that had been sanctioned in the past but had been disbursed only recently. She added that project, however, were now taking longer to start and loan sanctions for new projects had also slowed down.In such a scenario, an interest rate cut or more liquidity into the system cannot be the real fix. The investment situation definitely has to improve for the bank to maintain its current form.For now, the Street is celebrating the bank’s upbeat performance: the stock ended 5.87 percent at Rs 902.

PALO ALTO, CA –Mark Zuckerberg announced that Facebook will be shut down in March of 2012. Managing the site has become too stressful.“Facebook has gotten out of control,” said Zuckerberg in a press conference outside his Palo Alto office, “and the stress of managing this company has ruined my life. I need to put an end to all the madness.”Zuckerberg went on to explain that starting March 15th of next year, users will no longer be able to access their Facebook accounts. That gives users (and Facebook addicts) a year to adjust to life without Facebook.“After March 15th, 2012 the whole website shuts down,” said Avrat Humarthi, Vice President of Technical Affairs at Facebook. “So if you ever want to see your pictures again, I recommend you take them off the internet. You won’t be able to get them back after Facebook goes out of business.”Zuckerberg said the decision to shut down Facebook was difficult, but that he does not think people will be upset.“I personally don’t think it’s a big deal,” he said in a private phone interview. “And to be honest, I think it’s for the better. Without Facebook, people will have to go outside and make real friends. That’s always a good thing.”Some Facebook users were furious upon hearing the shocking news.“What am I going to do without Facebook?” said Denise Bradshaw, a high school student from Indiana. “My life revolves around it. I’m on Facebook at least 10 hours a day. Now what am I going to do with all that free time?”However, parents across the country have been experiencing a long anticipated sense of relief.“I’m glad the Facebook nightmare is over,” said Jon Guttari, a single parent from Detroit. “Now my teenager’s face won’t be glued to a computer screen all day. Maybe I can even have a conversation with her.Those in the financial industry are criticizing Zuckerberg for walking away from a multibillion dollar franchise. Facebook is currently ranked as one of the wealthiest businesses in the world, with economists estimating its value at around 7.9 billion.But Zuckerberg remains unruffled by these accusations. He said he will stand by his decision to give Facebook the axe.“I don’t care about the money,” said Zuckerberg. “I just want my old life back.”The Facebook Corporation suggests that users remove all of their personal information from the website before March 15th, 2012. One of the world’s most popular file-sharing sites was shut down on Thursday, and its founder and several company officials were accused of facilitating millions of illegal download of films, music and other content.A federal indictment accused Megaupload.com of costing copyright holders at least $500 million in lost revenue. The indictment was unsealed one day after websites including Wikipedia and Craigslist shut down in protest of two congressional proposals intended to make it easier for authorities to go after sites with pirated material, especially those with overseas headquarters and servers.The news of the shutdown seemed to bring retaliation from hackers who claimed credit for attacking the Justice Department’s website. Federal officials confirmed it was down on Thursday evening and that the disruption was being “treated as a malicious act.”A loose affiliation of hackers known as “Anonymous” claimed credit for the attack. Also hacked was the site for the Motion Picture Association of America and Universalmusic, the site of the Departnment of Justice, the site of the US copyright office among others.Megaupload is based in Hong Kong, but some of the alleged pirated content was hosted on leased servers in Ashburn, Va., which gave federal authorities jurisdiction, the indictment said.The Justice Department said in a statement said that Kim Dotcom, 37, and three other employees were arrested on Thursday in New Zealand at the request of US officials. Three other defendants are at large.The Electronic Frontier Foundation, which defends free speech and digital rights online, said in a statement that, “This kind of application of international criminal procedures to Internet policy issues sets a terrifying precedent. If the United States can seize a Dutch citizen in New Zealand over a copyright claim, what is next?”Before Megaupload was taken down, it posted a statement saying allegations that it facilitated massive breaches of copyright laws were “grotesquely overblown.”“The fact is that the vast majority of Mega’s Internet traffic is legitimate, and we are here to stay. If the content industry would like to take advantage of our popularity, we are happy to enter into a dialogue. We have some good ideas. Please get in touch,” the statement said.Meanwhile, the DOJ said its web server for justice.gov was “experiencing a significant increase in activity, resulting in a degradation in service.” It was working to fix it and “investigate the origins of this activity, which is being treated as a malicious act until we can fully identify the root cause of the disruption,” the agency’s statement said.A spokesman for the Motion Picture Association of America said in an emailed statement that the group’s site had been hacked, although it appeared to be working later in the evening.“The motion picture and television industry has always been a strong supporter of free speech,” the spokesman said. “We strongly condemn any attempts to silence any groups or individuals.”Megaupload was unique not only because of its massive size and the volume of downloaded content, but also because it had high-profile support from celebrities, musicians and other content producers who are most often the victims of copyright infringement and piracy. Before the website was taken down, it contained endorsements from Kim Kardashian, Alicia Keys and Kanye West, among others.The company listed Swizz Beatz, a musician who married Keys in 2010, as its CEO. He was not named in the indictment and declined to comment through a representative.According to the indictment, Megaupload was estimated at one point to be the 13th most frequently visited website on the Internet. Current estimates by companies that monitor Web traffic place it in the top 100.The five-count indictment, which alleges copyright infringement as well as conspiracy to commit money laundering and racketeering, described a site designed specifically to reward users who uploaded pirated content for sharing, and turned a blind eye to requests from copyright holders to remove copyright-protected files.For instance, users received cash bonuses if they uploaded content popular enough to generate massive numbers of downloads, according to the indictment. Such content was almost always copyright protected.The site boasted 150 million registered users and about 50 million hits daily. The Justice Department said it was illegal for anyone to download pirated content, but their investigation focused on the leaders of the company, not end users who may have downloaded a few movies for personal viewing.A lawyer who represented the company in a lawsuit last year declined comment Thursday. Efforts to reach an attorney representing Dotcom were unsuccessful.Megaupload is considered a “cyberlocker,” in which users can upload and transfer files that are too large to send by email. Such sites can have perfectly legitimate uses. But the Motion Picture Association of America, which has campaigned for a crackdown on piracy, estimated that the vast majority of content being shared on Megaupload was in violation of copyright laws.The website allowed users to download some content for free, but made money by charging subscriptions to people who wanted access to faster download speeds or extra content. The website also sold advertising.The indictment was returned in the Eastern District of Virginia, which claimed jurisdiction in part because some of the alleged pirated materials were hosted on leased servers in Ashburn, Va. Prosecutors there have pursued multiple piracy investigations.Steven T. Shelton, a copyright lawyer at the Cozen O’Connor firm in New York, said opponents of the legislation are worried the proposals lessen the burden for the government to target a wide variety of websites. Shelton said he expects to see the government engage in more enforcement in the future, as technology makes it easier to catch and target suspected pirates.“I think we’ll be seeing more of this,” he said. “This is just the beginning.”Dotcom, a resident of both Hong Kong and New Zealand, and a dual citizen of Finland and Germany, made more than $42 million from the site in 2010 alone, according to the indictment.Dotcom had his name legally changed. He was previously known as Kim Schmitz and Kim Tim Jim Vestor. He is founder, former CEO and current chief innovation officer of Megaupload.Officials estimated it could be a year or more before Dotcom and the others arrested in New Zealand are formally extradited.The others arrested were Finn Batato, 38, a citizen and resident of Germany, the company’s chief marketing officer; Mathias Ortmann, 40, a citizen of Germany and resident of both Germany and Hong Kong, who is the chief technical officer, co-founder and director; and Bram van der Kolk, aka Bramos, 29, a Dutch citizen and resident of both the Netherlands and New Zealand, who oversees programming.Still at large are Julius Bencko, 35, a citizen and resident of Slovakia, the site’s graphic designer; Sven Echternach, 39, a citizen and resident of Germany, head of business development; and Andrus Nomm, 32, a citizen of Estonia and resident of both Turkey and Estonia, head of the development software division.Several sister sites were also shut down, including one dedicated to sharing pornography files.AP

And with me, in-studio, is Mickey Huff. “Circulating on the internet now is a new film “On the Dark Side in Al Doura,” which focuses on U.S. Army Ranger John Needham’s experience in Iraq where he witnessed war crimes and some rather grim atrocities. He tried to blow the whistle on that and he, in the process of being there, was blown up like 14 times, had traumatic brain injury, post-traumatic stress, shrapnel throughout his body, ended up back here in the U.S. under some dire situations, and is now deceased.“We have on the line the producer from the film “On the Dark Side in Al Doura” Cindy Peister. Cindy, are you with us?” Cindy Peister (c. 0:00): “Yes, I am.”Dr. Peter Phillips (c. 0:00): “Great to have you, Cindy.”Cindy Peister (c. 38:47): “Thank you.”Dr. Peter Phillips (c. 38:48): “And also on the line is Michael Needham. He is John Needham’s father. And both are going to talk about the film and the importance of these very serious accusations against U.S. Military. “Cindy, tell us about the film and how people can see it.”Cindy Peister (c. 39:05): “Thank you, Peter. First of all, I just wanna thank you and Mickey for having us on and Project Censored for all the incredible work that you have done to get stories like this out to the public that they wouldn’t, otherwise, know. “Actually, I did more than produce it. I wrote the script and directed it. So, I’m really familiar with the material. “We met Michael in March of this year. I did an interview with him in our own independent media, Pulse TV and Maverick Media, out of Ventura. And we were all stunned. The crew and I were all stunned by Michael’s presentation of his son’s story. John’s story is so tragic and Mike, himself, is so genuine and the atrocities are so vicious and so dark, we made a commitment on the spot to Mike that we would do whatever it took to help him get the story out. “We thought that it would be a lot better if Big Media put it out. They have millions of viewers, but Mike had already had a number of disappointments in that regard. We did sit it out and wait for Time Magazine to release the photos and stories that they had said that they didn’t do it, of course. “And then we went full speed ahead on getting our film out after CBS produced its show on John’s story November 12th. They did cover aspects of veterans’ concerns that were really important, but they didn’t really focus on atrocities. And Mike and I had really wanted to get this story out to the public. We just felt it was in the public interest and it had to be done.“So, we just pushed forward at that point. We want accountability for these crimes. And we want John’s story to be out there. We had to turn to the activist community to distribute the film. And it went out through the Occupy Movements, even across Europe. David Swanson got the film and John’s letter to the Military authorities, in which he had tried to inform them of the atrocities. He got that put out on Truth Out and now Project Censored is putting it out. We really appreciate your support.“We did get hundreds of thousands of hits [on-line] and twenty-something plays just the first five days.”Dr. Peter Phillips (c. 41:38): “Cindy, how can people see this online at this point? And it’ll probably come out from the Truth Out site.Dr. Peter Phillips (c. 42:10): “That’s great. And we’ll probably have links to it as well on our site.”Cindy Peister (c. 42:13): “Thank you.”Dr. Peter Phillips (c. 42:14): “On the line with us, also, is Michael Needham, John’s father. Michael, are you there?”Michael Needham (c. 42:21): “Yes, I am. Can you hear me okay?”Dr. Peter Phillips (c. 42:23): “Yes we can. Thank you very much for coming on. I saw the video this week. It’s shocking. It’s a tragedy of what happened to your son. It’s also a tragedy of what was happening to other Iraq people in Baghdad, Iraqis who were killed in front of him. And he tries to blow the whistle and reports that.“Tell us a little bit about what happened.”Michael Needham (c. 42:46): “Well, basically, my son grew up in San Clemente, California. He is one of five children; he’s my middle son. And John was always a very active, athletic, you know, he was a very high achiever, a very fearless person. He had a number of different opportunities. He was in the pro surfing circuit in Southern California. In 2005, he had actually won the Open Men’s Competition in a contest in Southern California that went on for four months. So, he was pretty much on the fast track to pro surfing. And he was also very interested in art and music. “So, within a period of time he started getting involved in watching different shows like Band of Brothers and you know, Saving Private Ryan. We lived in San Clemente, only minutes from a Marine base, Camp Pendleton. And this overwhelming, kind of, nationalistic feeling that the country was going through at that time motivated him to think about going into the Military and going and fighting for quote-unquote ‘our freedom.’ “So, long-story-short, basically, I’m a Vietnam Veteran, ex-Army Officer and I tried to talk him out of it. But he went ahead and made that choice. Well, fast-forward. “He went through all this training. He got deployed to Iraq in 2006 with a unit out of Fort Carson called the 212, 2nd Infantry Division, 12th Regiment, a [tech] and combat team. And that particular unit became very, very infamous for these types of actions while they were in Iraq. His unit was an Apocalyptic Now, type of unit, where you had a colonel, battalion commander, use these tactics of basically terrorising and murdering and dismembering bodies. If anyone’s familiar with the trophy murders that were in Afghanistan. This makes that look like a small-scale operation. “So, with the time we have on the phone right now, what I’d like everybody to do is look at the video on Vimeo. And the real important thing here is that, as a parent, as a father or someone’s husband or son or uncle, people need to know the reality of what happened in Iraq. And this is not an isolated case. This is an entire battalion in southern Baghdad that basically targeted, murdered, and racketeered, basically, an entire neighbourhood through the leadership of the 2nd Infantry Division that was commanding at the time.“The atrocities are real. I got the photographs. I presented them. I went through a number of situations of dealing with the government, dealing with the Army, dealing with the Department of Defense, the White House trying to get people to take a look and take action. But, basically, it was covered up. I had major publications that were on the story and at time of release, I was told that they weren’t gonna do it. In the case of The Washington Post, I was told that they were not going to run the story because they were basically told by the Pentagon that if they run the story that they would not have access like other agencies to breaking news.“They were basically you know telling them that if you run the story, we’re gonna blackball you.” Mickey Huff (c. 46:41): “It’s elite sourcing, a form of censorship. “We’re speaking with Cindy Peister and Michael Needham about a new video On the Dark Side in Al Doura: A Soldier in the Shadows addressing soldiers’ war crimes allegations and Iraq atrocity photos.“Michael, I’m sorry for interrupting you; I just wanted to point out, you were talking about The Washington Post; CBS also reported on this. CBS did a programme on this. And when they contacted the Army it was such that they claimed that war crimes did not occur, though CBS also stated that the report was redacted and incomplete with 111 pages withheld. And the report claimed that when soldiers were asked about specific photos, one showing an individual with his brains pulled out atop a Military vehicle, they were told, quote, ‘We didn’t have any body bags that day. So, we put him on the hood of the vehicle for transport.’“I mean this is the kind of thing that you’re talking about and the kind of thing you’re saying The Washington Post doesn’t want to talk about.”Michael Needham (c. 47:38): “Well, yeah. And, basically, when we’re talking about that particular instance, which is one of hundreds and he’s documented with photos and with collaborative soldiers’ stories, is just a juvenile, sophomoric way of blowing this off. Okay? I mean I don’t want to go into too much detail right now because it’s a radio show. We’re limited on time. But being former Army, I understand what they need to do. You would never drive a body around on a hood.“What really happened at that time was that Iraqi was standing on the street and was shot and killed, point blank in the head. They drug him on the hood. They took his brains out. And then they drove him around the neighbourhood with an interpreter blaring out threats in Arabic that if the citizens of the moulah, or the neighbourhood, in Al Doura did not cooperate with them that that’s what their end would be. “They were terrorists themselves. They were killing civilians, robbing, stealing, just out of control. It really is like an Apocalypse Now situation.“The story with my son is even more interesting because basically I documented this thing from the very first minute he went in the Army. And I don’t want, like I said, we have limited amount of time, but every claim we make, everything we say, we have dates, times, photographs, collaboration.”Dr. Peter Phillips (c. 49:07): “Michael, I think this is a really important story. John, your son, tried to tell this. He was subsequently came back to the U.S. He is now deceased. There are circumstances, all of this, which need to be investigated and brought forward. So, I had an opportunity to sit down and talk with Abby about the work she does, certainly the work she’s done covering the local Occupy Movement. So, here’s a brief interview with Abby Martin of Media Roots. “For the One-Year Anniversary programme here at The Morning Mix Project Censored Show we wanted to, actually, talk to one of our co-hosts Abby Martin of Media Roots, who’s also a board member at Media Freedom Foundation.“Abby, let’s just hear some of your reflections on the past year. What have you been doing with Media Roots, some of the highlights that you’ve done here on the show, and some of the work you’re doing with Project Censored?”Abby Martin (c. 52:05): “Well, Mickey, I started Media Roots about a year and a half ago, starting off as just a news aggregate, just to have a vast collection of underreported news, kind of, what you guys were already doing in my own way and adding kind of a personal, personality, to it. “And then over time it turned into a citizen journalism project where people continually started pulling information from all over the world and submitting contributions. And it ended up being way bigger than I imagined. And getting involved with Project Censored and now intertwining the two, it’s really exciting. “Occupy Oakland, when that took off, I was on the ground every day when things were happening. And that’s when the citizen journalism aspect of it really shined because I was able to tell the story of what was happening from the ground up instead of top down. And we saw you know obviously the corporate news got that a lot wrong and said that people, you know, the crowd control methods that they used, those draconian crowd control methods, were warranted. Really, it was up to citizen journalism to really tell the story of what was going on at that time.”Mickey Huff (c. 53:14): “And we’ve certainly been fortunate to have been working with you over the past year. We certainly look forward to doing more of that. What you’re describing sounds a lot like the name of the website, of the organisation, Media Roots.org. Media Roots—radical, meaning, go to the roots and have a bottom-up kind of construction of a people’s narrative. That’s what you’re getting at.”Abby Martin (c. 53:35): “Absolutely. We see the top-down corporate consolidation and control of the message, it’s institutionalised; it’s not organic. And Media Roots is, really, it’s from the ground up. It’s true activism. It’s true grass-roots journalism where you’re getting the story from each other like Robert McChesney said in the interview, ‘It’s not paid.’ Yeah, we accept donations, but we’re not influenced by any corporate donor or any sort of dogmatic principles. We are for the truth. We are completely unbiased. We report from outside party lines, just like Project Censored does. And it’s really important to have that.” Mickey Huff (c. 54:20): “Hitting on the notion of reform, Elizabeth Cady Stanton once wrote, ‘Reformers who are always compromising have not yet grasped the idea that truth is the only safe ground to stand upon.’“And, of course, we won’t pretend that there’s only one truth. There are many different ways people can interpret things. But one of the biggest problems that we have in our media structure here is that people don’t get all of the relevant facts. And, of course, the bottom-up, the vernacular view, the media root, going straight to the street, so to speak, that’s often the view that’s really missing. And certainly at Media Roots, you’ve been doing that. You have been covering Occupy Oakland. “And you are also working with some people on a film about Occupy Wall Street. Is that correct? Could you talk to us, at least, briefly about some of that and maybe some of the narrative? What’s the Media Roots connection there? And what do you hope to accomplish?”Abby Martin (c. 55:13): “Yeah. There’s a great film; it’s called The Occupy Wall Street Collaborative Film Project based in New York, run by a woman named Audrey Ewell.“This whole concept that we’re talking about, citizen journalism, they’re pulling together everyone’s footage across the world that has been participating in covering the Occupy Wall Street Movement and putting it together in a collaborative project.“I’m gonna be part director. I’m submitting my Occupy Oakland footage, exclusively, to represent this area. And it’s just a real exciting grassroots project with a bunch of journalists who are gonna get together and put together a citizen journalism film highlighting this Movement.” Mickey Huff (c. 55:50): “We’ve been talking with Abby Martin of Media Roots. Russian Space Probe Crashes Into Pacific Ocean

Phobos-Grunt, the failed Russian space probe that was slated to visit the Martian moon Phobos, crashed into the Pacific Ocean, Russian news agencies report.The probe hit Earth at around 12:45 p.m. EST Sunday, some 775 miles west of the coastal island of Wellington.“Phobos-Grunt fragments have crashed down in the Pacific Ocean,” Alexei Zolotukhin, an official with Russia’s Defense Ministry, said to Ria Novosti.The probe, described by one expert as the “most toxic falling satellite ever,” was launched on Nov. 9, 2011 with a mission to take soil samples from Phobos and fly them back to Earth. However, shortly after launch it stopped responding to commands, and in December the European Space Agency said it will stop attempts to save it.If it were successful, the $165-million probe would be Russia’s first successful interplanetary mission in over 20 years.[via Reuters]

যে পদ্ধতির সরকারই ক্ষমতায় থাকুক, চারটি মন্ত্রণালয় ইসির পরামর্শে চললে গ্রহণযোগ্য নির্বাচন সম্ভব’Å ঝুলে আছে একগুচ্ছ সংস্কার প্রস্তাবÅ তত্ত্বাবধায়ক পদ্ধতির বিলুপ্তির সময় ইসির ক্ষমতা বৃদ্ধির প্রতিশ্রুতি দিয়েছিল সরকারতত্ত্বাবধায়ক সরকারের বিকল্প হিসেবে নির্বাচন কমিশনের (ইসি) ক্ষমতা বাড়ানোর কোন প্রচেষ্টা নেই সরকারের। তত্ত্বাবধায়ক সরকার বিলুপ্তির সময় বর্তমান সরকার জোর দিয়ে বলেছিল ইসিকে শক্তিশালী, স্বাধীন করা হবে এবং তাদের ক্ষমতা বাড়ানো হবে। বাস্তবে ইসির ক্ষমতা বাড়েনি। রাজনৈতিক দলগুলোর সঙ্গে সংলাপের পর রাষ্ট্রপতি শুধুমাত্র কমিশনের নিয়োগ পদ্ধতি নিয়ে আইন প্রণয়নের সুপারিশ করেছেন। এদিকে ইসির একগুচ্ছ সংস্কার প্রস্তাবের ব্যাপারে গত ছয় মাসেও ক্ষমতাসীন আওয়ামী লীগ কোন মতামত দিতে পারেনি। প্রধান বিরোধী দল বিএনপির সংসদ বর্জন এখনো অব্যাহত রয়েছে। সংবিধান সংশোধন কমিটির কাছেও ইসির সংস্কার প্রস্তাব গুরুত্ব পায়নি। এবার খোদ প্রধানমন্ত্রীর সঙ্গে দেখা করে সংস্কার প্রস্তাব দেয়ার সিদ্ধান্ত নিয়েছে নির্বাচন কমিশন।এ প্রসঙ্গে গতকাল শনিবার সন্ধ্যায় প্রধান নির্বাচন কমিশনার (সিইসি) ড. এটিএম শামসুল হুদা ইত্তেফাককে বলেন, ‘আমরা প্রধানমন্ত্রীর কাছে সাক্ষাতের সময় চেয়েছি। সময় পেলে সংস্কার প্রস্তাব তার হাতে তুলে দেবো।’ তিনি বলেন, নির্বাচনকে অবাধ, সুষ্ঠু ও সকলের কাছে গ্রহণযোগ্য করতে হলে নির্বাচন কমিশনের সংস্কার প্রস্তাবে সরকার ও রাজনৈতিক দলগুলোকে গুরুত্ব দিতে হবে।গত বছরের জুন মাসে রাজনৈতিক দলগুলোর সঙ্গে নির্বাচন কমিশনের অনুষ্ঠিত সংলাপে তিনটি আইন ও একটি বিধিমালার খসড়া উপস্থাপন করেছিল কমিশন। এগুলো হচ্ছে-গণপ্রতিনিধিত্ব আদেশ (আরপিও) আরো সংশোধন, নির্বাচনী প্রচারের ব্যয় (জনতহবিল) আইন, সিইসি ও ইসি নিয়োগ পদ্ধতি, সীমানা নির্ধারণ আইন, ইলেকট্রনিক ভোটিং মেশিন (ইভিএম) ও একটি বিধিমালার খসড়া। আরপিও ৪৪ (ই) ধারার সংশোধনী প্রস্তাবে বলা আছে, নির্বাচনের তফসিল ঘোষণার দিন থেকে ফল ঘোষণার পর ১৫ দিন পর্যন্ত মহানগর পুলিশ কমিশনার, জেলা প্রশাসক, পুলিশ কমিশনার ও তাদের অধীনস্থ কর্মকর্তাদের ইসির সঙ্গে আলোচনা না করে বদলি করা যাবে না। এছাড়া সংসদ নির্বাচনের পূর্ববর্তী ৯০ দিন সময়ের জন্য মন্ত্রিপরিষদ বিভাগ, স্থানীয় সরকার, স্বরাষ্ট্র ও জনপ্রশাসন মন্ত্রণালয়ের দায়িত্ব নিজের কাছে রাখতে চায় নির্বাচন কমিশন। এ প্রসঙ্গে নির্বাচন কমিশনার বিগ্রেডিয়ার জেনারেল (অব.) এম সাখাওয়াত হোসেন বলেন, নির্বাচনের সময় যে পদ্ধতির সরকার ক্ষমতায় থাকুক না কেন চারটি মন্ত্রণালয় ইসির পরামর্শে কাজ করলে দলীয় প্রভাবমুক্ত ও গ্রহণযোগ্য নির্বাচন করা সম্ভব। আরপিও ৪৪ (বি) ধারা সংশোধনের প্রস্তাব রয়েছে নির্বাচন কমিশনের। এ ধারার মাধ্যমে নির্বাচন ব্যয় নিয়ন্ত্রণ করতে চায় কমিশন। প্রস্তাবে বলা হয়েছে, প্রতিটি সংসদীয় আসন ইসির নিজস্ব এক বা একাধিক পর্যবেক্ষক দল থাকবে। তারা প্রতিদিন প্রার্থীদের নির্বাচনী খরচের উপর নজর রাখবে। কোন প্রার্থীর বিরুদ্ধে নির্বাচনী খরচের লংঘনের অভিযোগ পেলে তাও তারা খতিয়ে দেখবে। প্রার্থীদেরও ব্যয়ের প্রতিদিনের হিসাব প্রতি সাতদিন পর জমাদানের বিধান রাখার প্রস্তাব করা হচ্ছে। কোন প্রার্থী এ বিধান লংঘন করলে পর্যবেক্ষক দল ঐ প্রার্থীর প্রার্থিতা বাতিল করতে পারবে।নির্বাচন কমিশনের এই সংস্কার প্রস্তাব সংক্রান্ত সংলাপ প্রধান বিরোধী দল বিএনপি বর্জন করে। তাদের সঙ্গে সংলাপে যোগ দেয়া নিয়ে কমিশনের একাধিকবার চিঠি আদান-প্রদান হয়েছে। বিএনপি ও চার দলীয় জোট সংলাপে তো যায়ই নি, এমনকি লিখিত কোন মতামতও দেয়নি। আর ক্ষমতাসীন দল আওয়ামী লীগ সংলাপ দীর্ঘদিন ঝুলিয়ে রাখে। দু’দফা সময় নিয়ে সংলাপে যোগ দেয়ার পর আওয়ামী লীগ কমিশনের প্রস্তাবিত সংস্কার প্রস্তাব সম্পর্কে কোন ধরনের মতামত দেয়নি। দলের সাধারণ সম্পাদক ও স্থানীয় সরকার মন্ত্রী সৈয়দ আশরাফুল ইসলাম কমিশনকে জানান, তারা কমিশনের প্রস্তাব সম্পর্কে জানতে এসেছেন। এই মুহূর্তে কোন মতামত দেয়া সম্ভব নয়। দলের সভানেত্রীর সঙ্গে আলোচনা করে তাদের দলীয় মতামত পরে এসে নির্বাচন কমিশনকে জানাবেন। কিন্তু গত ছয় মাসেও আওয়ামী লীগের মতামত জানানো হয়নি। এমনকি নির্বাচন কমিশনও আওয়ামী লীগকে এ বিষয়ে কোন তাগাদা দেয়নি।এ বিষয়ে সিইসি বলেন, আমরা আওয়ামী লীগের জন্য অপেক্ষা করেছিলাম। কিন্তু তারা আর আসেননি। এখন অপেক্ষার সুযোগ নেই। বিএনপির ব্যাপারে তিনি বলেন, তাদের সঙ্গে সংলাপে অংশ নেয়ার জন্য চিঠি দেয়া হলেও সাড়া দেয়নি। পরবর্তী কমিশন এসে তাদের সঙ্গে আলোচনা করবে।এক পর্যায়ে গত জুনে সিইসির নেতৃত্বে দুই কমিশনার সংবিধান সংশোধন সংক্রান্ত কমিটির সঙ্গে বৈঠক করে। তাদের লিখিত প্রস্তাব দাখিল করে। কিন্তু কমিশনের মাত্র একটি প্রস্তাব গ্রহণ করা হয়। তা হলো-নির্বাচন সংক্রান্ত কোন বিষয়ে স্থগিতাদেশ দেয়ার আগে ইসিকে নোটিস দিয়ে শুনানির সুযোগ দিতে হবে।রাষ্ট্রপতির সঙ্গে রাজনৈতিক দলগুলোর সংলাপ গত বৃহস্পতিবার শেষ হয়। ওই সংলাপে অধিকাংশ রাজনৈতিক দল তত্ত্বাবধায়ক সরকার পদ্ধতি পুনর্বহাল এবং নির্বাচন কমিশনের ক্ষমতা বাড়ানোর প্রস্তাব দিয়েছে। সংলাপ শেষে বঙ্গভবন থেকে মন্ত্রিপরিষদ বিভাগে একটি সুপারিশ পাঠানো হয়েছে। সুপারিশে শুধুমাত্র নির্বাচন কমিশন গঠনের বিষয়টি স্থান পেয়েছে। একটি অনুসন্ধান কমিটির মাধ্যমে নির্বাচন কমিশন গঠন করা যায় কিনা তা বিবেচনায় নিয়ে আইন বা বিধি প্রণয়নের সুপারিশ করেছেন রাষ্ট্রপতি।বিষেজ্ঞরা মনে করেন, তত্ত্বাবধায়ক সরকার বাতিলের প্রেক্ষাপটে নির্বাচন কমিশনের ক্ষমতা আরো না বাড়ানো হলে দলীয় সরকারের অধীনে সুষ্ঠু নির্বাচন আয়োজন করা দুরূহ। এ প্রসঙ্গে নির্বাচন কমিশনের আইনজীবী ড. শাহদীন মালিক বলেন, পঞ্চদশ সংশোধনীতে নির্বাচন কমিশনে কোন ক্ষমতায় বাড়ানো হয় নি। বরং তত্ত্বাবধায়ক সরকার বাতিল হওয়ায় জাতীয় নির্বাচনের সময় নির্বাচন কমিশনের উপর রাজনৈতিক সরকারের প্রভাব বিস্তারের সুযোগ তৈরি হয়েছে। তিনি বলেন, নির্বাচনের সময় সরকারি কর্মচারীদের শৃঙ্খলাবিধি প্রণয়নের ক্ষমতা ইসির হাতে ন্যস্ত করতে হবে। যাতে সরকার ইসির অমতে সরকারি কর্মকর্তা-কর্মচারীদের বদলি বা পদোন্নতি দিতে না পারে। আইন-শৃঙ্খলা বাহিনীকেও নির্বাচন কমিশনের নিয়ন্ত্রণে নিয়ে আসতে হবে। প্রসঙ্গত, খোদ নির্বাচন কমিশনের সচিব নিয়োগই জনপ্রশাসন মন্ত্রণালয় দিয়ে থাকে।
